Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on State Affairs was held on Thursday, April 23, 2009, in the Senate Chamber.

The chair called the meeting to order at 4:10 p.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out as a matter of pending business SB 18. 

 

Senator Fraser sent up a committee substitute; the chair recognized Senator Estes and Senator Hegar to explain the difference between the committee substitute and the senate bill as filed.  Senator Duncan moved adoption of the committee substitute; without objection, it was so ordered.  Senator Fraser moved that SB 18 do not pass but that CSSB 18 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 4 absent. 

 

The chair laid out as a matter of pending business SB 1257.  Senator Deuell sent up a committee substitute; the chair recognized Senator Averitt to explain the difference between the committee substitute and the senate bill as filed.  Senator Duncan moved that SB 1257 be left pending; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 392.  Senator Fraser sent up a committee substitute.  Senator Duncan moved adoption of the committee substitute; without objection, it was so ordered.  Senator Duncan moved that SB 392 be left pending; without objection, it was so ordered.

 

The chair laid out SB 2394 and recognized the author, Senator Gallegos, Jr., to explain the bill.  The chair opened public testimony.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.   Senator Duncan moved that SB 2394 be left pending; without objection, it was so ordered.   

 

The chair laid out SB 2067 and recognized the author, Senator Davis, to explain the bill.  The chair opened public testimony.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Duncan moved that SB 2067 be left pending to await a quorum; without objection, it was so ordered.  Upon arrival of a quorum, Senator Lucio, Jr. moved that SB 2067 do not pass but that CSSB 2067 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent.

The chair laid out as a matter of pending business SB 1912.  Senator Duncan sent up a new committee substitute; the chair recognized Senator Duncan to explain the difference between the committee substitute and the senate bill as filed.  Senator Deuell moved adoption of the committee substitute; without objection, it was so ordered.  Upon arrival of a quorum, Senator Duncan moved that SB 1912 do not pass but that CSSB 1912 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 1 nay, 0 present not voting, and 3 absent.

The chair laid out SB 1025 and SJR 29 and recognized the author, Senator Ogden, to explain the bill and resolution.  Senator Deuell sent up a committee substitute for SB 1025 and SJR 29; the chair recognized Senator Ogden to explain the difference between the committee substitutes and the senate bill and joint resolution as filed.  The chair opened public testimony.  Witnesses registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Duncan moved that SB 1025 be left pending; without objection, it was so ordered.

The chair laid out SB 1068 and recognized the author, Senator Wentworth, to explain the bill.  The chair opened public testimony.  Witnesses registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Deuell moved that SB 1068 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 4 absent.  Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out SB 1630 and recognized the author, Senator Wentworth, to explain the bill.  Senator Lucio, Jr. sent up a committee substitute; the chair recognized Senator Wentworth to explain the difference between the committee substitute and the senate bill as filed.  Senator Duncan moved adoption of the committee substitute; without objection, it was so ordered.  Senator Lucio, Jr. sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.  The chair opened public testimony.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Duncan moved that SB 1630 be left pending to await a quorum; without objection, it was so ordered. 

 

The chair laid out SB 485 and recognized the author, Senator Deuell, to explain the bill.  Senator Deuell sent up a committee substitute and was recognized to explain the difference between the committee substitute and the senate bill as filed.   The chair opened public testimony.  Witnesses testifying and registering on the bill are shown on the attached list.

The chair laid out as a matter of pending business SB 1858.  Senator Duncan moved adoption of the committee substitute; without objection, it was so ordered.  Senator Deuell moved that SB 1858 do not pass but that CSSB 1858 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent.

 

The chair laid out as a matter of pending business SB 1630.    Senator Deuell requested unanimous consent to roll the amendments into a committee substitute; without objection, it was so ordered.  Senator Lucio, Jr. then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Deuell moved that SB 1630 do not pass but that CSSB 1630 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 4 absent.

 

 

There being no further business, at 6:55 p.m. Senator Duncan moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
