Pursuant to suspension of Senate Rules 11.10 and 11.18, a public hearing of the Senate Committee on Criminal Justice was held on Wednesday, March 25, 2009, at Senator Whitmire's Desk.

The chair called the meeting to order at 2:28 p.m.  There being a quorum present, the following business was transacted: 

 

As a matter of pending business, the chair laid out SB 269.  Senator Ellis moved that SB 269 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Ellis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.      

 

As a matter of pending business, the chair laid out SB 707.  Senator Hinojosa moved that SB 707 do not pass but that CSSB 707 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Whitmire moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out SB 709.  Senator Ellis moved that SB 709 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Ellis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

As a matter of pending business, the chair laid out SB 1091.  Senator Ellis moved that SB 1091 do not pass but that CSSB 1091 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 3 absent.  Senator Ellis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.   

 

As a matter of pending business, the chair laid out SB 1278.  Senator Hegar moved that SB 1278 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 3 absent.

 

As a matter of pending business, the chair laid out SJR 11.  Senator Ellis moved that SJR 11 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 3 absent. 

 

Senator Carona requested unanimous consent to be shown voting aye on SB 269, CSSB 707, SB 709, SB 729, SB 808, SB 809, CSSB 1091, SB 1278, and SJR 11.

 

There being no further business, at 2:34 p.m. Senator Whitmire moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
