Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Finance was held on Monday, April 11, 2011, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 11:09 AM. There being a quorum present, the following business was transacted:

 

The chair laid out SB 1 as a matter of pending business.

 

Senator Williams laid out recommendations for Article VI.

 

The Legislative Budget Board gave testimony on the recommendation document.

 

Senator Williams moved to adopt Article VI rider, Texas Department of Agriculture, items 1 – 5.  Without objection, it was so ordered.

 

Senator Williams moved to adopt recommendations for items 6 and 7 for the Texas Department of Agriculture. The motion carried with a record vote of 10 ayes, 4 nays, 0 present not voting, and 1 absent.

 

Senator Williams moved to adopt the Texas Department of Agriculture recommendations, as amended. The motion carried with a record vote of 11 ayes, 3 nays, 0 present not voting, and 1 absent.

 

Senator Williams moved to adopt the amendment as amended for the Texas Commission on Environmental Quality. The motion carried with a record vote of 15 ayes, 0 nays, 0 present not voting, and 0 absent.

 

Senator Williams moved to adopt the Texas Commission on Environmental Quality, as amended.   The motion carried with a record vote of 14 ayes, 0 nays, 0 present not voting, and 1 absent.

 

Senator Williams moved to adopt the General Land Office recommendations. Without objection, it was so ordered.

 

Senator Williams moved to adopt Texas Parks and Wildlife, as amended.  The motion carried with a record vote of 12 ayes, 2 nays, 0 present not voting, and 1 absent.

 

Senator Williams moved to adopt recommendations for the Animal Health Commission. The motion carried with a record vote of 15 ayes, 0 nays, 0 present not voting, and 0 absent.

 

Senator Williams moved to adopt recommendations for the Railroad Commission, as amended. The motion carried with a record vote of 15 ayes, 0 nays, 0 present not voting, and 0 absent.

 

Senator Williams moved to adopt recommendations for the Soil and Water Conservation Board.  The motion carried with a record vote of 15 ayes, 0 nays, 0 present not voting, and 0 absent.

 

Senator Williams moved to adopt recommendations for the Texas Water Development Board.  The motion carried with a record vote of 15 ayes, 0 nays, 0 present not voting, and 0 absent.

 

Senator Williams moved to adopt recommendations for the Debt Service Payments – Non-Self Supporting G.O. Water Bonds. The motion carried with a record vote of 15 ayes, 0 nays, 0 present not voting, and 0 absent.

 

At 12:57 PM Senator Ogden moved that the Committee stand recessed until 30 minutes after adjournment of the Senate. Without objection, it was so ordered.  

 

At 3:20 PM the Committee reconvened.

Senator Williams moved to adopt recommendations for the Department of Motor Vehicles.  Without objection, it was so ordered.

 

Senator Williams moved to adopt recommendations for the Texas Department of Rural Affairs. 

There being 7 ayes, 3 nays, 0 present not voting, and 5 absent, the motion failed to receive a majority vote of the Committee membership.

Senator Williams moved that the recommendations for the Texas Department of Transportation be left pending. Without objection, it was so ordered.

Senator Williams moved to adopt the recommendations for the Texas Workforce Commission.  Without objection, it was so ordered.

Senator Williams moved to adopt recommendations for the Reimbursements to the Unemployment Compensation Benefit Account. Without objection, it was so ordered.

Senator Williams moved to adopt recommendation for Special Provisions for Article VII.  Without objection, it was so ordered.  

 

Senator Ogden laid out Article I riders.

Senator Duncan moved adoption of the proposed rider, Contingency Appropriation for Outside Legal Counsel. Without objection, it was so ordered.

Senator Eltife moved adoption of the proposed rider, Contingent Revenue: 911 Service Fees. Without objection, it was so ordered.

Senator Hinojosa moved adoption of the proposed rider on Capitol Complex – Utilities. Without objection, it was so ordered.

Senator Lucio laid out the proposed rider, Small Contractor Participation Assistance Program.  Senator Ogden moved to leave the rider pending. Without objection, it was so ordered.

Senator Lucio laid out the proposed rider, PARIS Pilot Program. Senator Ogden moved to leave the rider pending. Without objection, it was so ordered.

Senator Ogden laid out Article III riders, Public Education.

Senator Shapiro moved adoption of the proposed rider, Student Success Initiative. Without objection, it was so ordered.

Senator Shapiro moved adoption of the proposed rider, Dropout Prevention and Intervention.  Without objection, it was so ordered.

Senator Lucio moved adoption of the proposed rider, Public School Counselor Report. Without objection, it was so ordered.

Senator Ogden moved to reconsider the vote by which the proposed rider, Student Success Initiative, was adopted. Without objection, it was so ordered.
