Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Finance was held on Monday, May 2, 2011, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 9:05 AM. The following business was transacted:

 

Senator West assumed the chair.

 

The chair laid out SB 1588 and recognized the author, Senator Ogden, to explain the bill.

 

Senator Ogden sent up a committee substitute; the chair recognized Senator Ogden to explain the difference between the committee substitute and the senate bill as filed.

 

No witnesses provided oral testimony or submitted witness cards for SB 1588.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Ogden resumed the chair.

 

The chair laid out SJR 53 and recognized the author, Senator Ellis, to explain the bill.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Ogden moved that SJR 53 be left pending; without objection, it was so ordered.

 

Senator West assumed the chair.

 

The chair laid out HB 4 and recognized the Senate sponsor, Senator Ogden, to explain the bill.

 

Senator Ogden sent up a committee substitute; the chair recognized Senator Ogden to explain the difference between the committee substitute and the senate bill as filed.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Ogden resumed the chair.

 

The chair laid out as a matter of pending business SB 1334 and recognized the author, Senator Deuell, to explain the bill.

 

Senator Deuell moved that SB 1334 do not pass but that CSSB 1334 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 15 ayes, 0 nays, 0 present not voting, and 0 absent.

 

Senator West assumed the chair.

The chair recognized Senator Ogden on SB 1588.

 

Senator West sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.

 

Senator Ogden requested unanimous consent to incorporate Committee Amendment 1 into the committee substitute; without objection, it was so ordered. Senator Ogden then moved that the committee substitute be adopted; without objection, it was so ordered. Senator Ogden moved that SB 1588 do not pass but that CSSB 1588 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 15 ayes, 0 nays, 0 present not voting, and 0 absent.

 

Senator Ogden resumed the chair.

 

Senator Hinojosa assumed the chair.

 

The chair recognized Senator Ogden on HB 4.

 

Senator Ogden moved adoption of the committee substitute to HB 4; without objection, it was so ordered.

 

Senator Ogden moved that HB 4 do not pass but that CSHB 4 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 13 ayes, 0 nays, 1 present not voting, and 1 absent.

 

Senator Ogden resumed the chair.

 

Senator Ogden announced that the Committee would stay in session until 10:40 AM for voting purposes. Without objection, it was so ordered.

 

There was no action taken on SB 1771.

 

Senator Duncan and Senator Whitmire submitted motions in writing and asked to be shown voting aye on the following bills: SB 1334, SB 1588 and HB 4.

 

There being no further business, at 10:40 AM Senator Ogden moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
