Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Nominations was held on Monday, March 28, 2011, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 9:00 A.M. Without a quorum being present, the following business was transacted:

 

Chairman Deuell read written remarks by Senator Kel Seliger introducing Monte D. Cluck, nominee to the Texas Water Development Board.

 

Upon arrival of a quorum, Senator Hegar moved adoption of the minutes from the previous hearing held on March 21, 2011; without objection, it was so ordered.

 

The following members arrived after the roll was called: Senator Jane Nelson and Senator Kirk Watson.

 

Monte D. Cluck and Billy R. Bradford, Jr., nominees to the Texas Water Development Board, made opening remarks.

 

Chairman Deuell recognized Senator Eddie Lucio to introduce Billy R. Bradford, nominee to the Texas Water Development Board.

 

Chairman Deuell recognized Senator Rodney Ellis to introduce Todd F. Barth, nominee to the Teacher Retirement System of Texas.

 

The Texas Water Development Board nominees answered questions from members of the committee.

 

Senator Nichols moved that the committee vote to approve the nominations of the individuals to the following entity: Texas Water Development Board. The motion carried with a record vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent. (Senator Nelson and Senator Watson submitted a voting form voting aye).

 

Chairman Deuell recognized Senator Robert Nichols to introduce Christopher S. Moss, nominee to the Teacher Retirement System of Texas Board of Trustees.

 

Chairman Deuell introduced F. Nanette Sissney, nominee to the Teacher Retirement System of Texas Board of Trustees.

 

Nominees to the Teacher Retirement System of Texas Board of Trustees answered questions from members of the committee.

 

Senator Hegar moved that the committee vote to approve the nominations of the individuals to the following entity: Teacher Retirement System of Texas. The motion carried with a record vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent. (Senator Nelson submitted a voting form voting aye).

 

Chairman Deuell read written remarks by Senator Jeff Wentworth introducing Robert Scott, Commissioner of Education.

 

Commissioner Scott made opening remarks and answered questions from members of the committee.

 

Senator Rodriguez moved that the committee vote to approve the nomination of Robert P. Scott as the Commissioner of Education. The motion carried with a record vote of 5 ayes, 0 nays, 0 present not voting, and 2 absent. (Senator Nelson submitted a voting form voting aye).

Senator Rodriguez moved that the committee vote to approve the nominations of the individuals to the following entities: Commission on Jail Standards, Texas Public Finance Authority, Texas State University System Board of Regents, Texas Underground Facility Notification Corporation (One-Call Board), University of North Texas System Board of Regents, and Upper Colorado River Authority. The motion carried with a record vote of 5 ayes, 0 nays, 0 present not voting, and 2 absent. (Senator Nelson submitted a voting form voting aye).

 

There being no further business, at 9:36 A.M. Senator Deuell moved that the committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
