Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Transportation & Homeland Security was held on Monday, June 13, 2011, in the Capitol Extension, Room E1.016, at Austin, Texas.

The chair called the meeting to order at 9:02 AM. There being a quorum present, the following business was transacted:

 

The following members arrived after the roll was called:

Senator Watson assumed the chair.

 

The chair laid out SB 9 and recognized the author, Senator Williams, to explain the bill.

 

Senator Williams sent up a committee substitute; the chair recognized Senator Williams to explain the difference between the committee substitute and the senate bill as filed.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

At 11:34 AM Senator Davis assumed the chair.

 

At 11:53 AM Senator Watson resumed the chair.

 

At 1:18 PM Senator Watson moved that the Committee stand recessed until after adjournment of the Senate. Without objection, it was so ordered.

 

At 3:43 PM Senator Watson reconvened the meeting.

 

Public testimony resumed.

 

At 5:25 PM Senator Davis assumed the chair.

 

At 5:35 PM Senator Watson resumed the chair.

 

At 6:39 PM Senator Davis assumed the chair.

 

At 6:41 PM Senator Watson resumed the chair.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Hinojosa sent up and explained Committee Amendment 1. 

 

Senator Hinojosa withdrew Committee Amendment 1.

 

Senator Davis sent up and explained Committee Amendment 2. 

 

Senator Davis withdrew Committee Amendment 2.

 

Senator Davis sent up and explained Committee Amendment 3. 

 

Senator Davis withdrew Committee Amendment 3.

 

Senator Davis assumed the chair.

 

Senator Watson sent up and explained Committee Amendment 4. 

 

Senator Watson withdrew Committee Amendment 4.

 

Senator Watson resumed the chair.

 

Senator Williams moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Williams moved that SB 9 do not pass but that CSSB 9 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 4 nays, 0 present not voting, and 0 absent.

 

Senator Ellis asked to be shown voting nay on SB 9.

 

Senator Williams assumed the chair.

 

There being no further business, at 6:45 PM Senator Williams moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
