Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Intergovernmental Relations was held on Monday, March 20, 2017, in the Capitol Extension, Room E1.028, at Austin, Texas.

The Chair called the meeting to order at 9:12 AM.  There being a quorum present, the following business was transacted:

 

The following members arrived after the roll was called: Senator Van Taylor.

 

The Chair laid out SB 884 and recognized the author, Senator Whitmire, to explain the bill.  The Chair sent up a committee substitute.  The Chair recognized Senator Whitmire to explain the difference between the committee substitute and senate bill as filed.  Senator Bettencourt moved adoption of the committee substitute; without objection, it was so ordered.  The Chair moved that public testimony be opened.  Witnesses testifying and registering on the bill are shown on the attached list.  The Chair moved that public testimony be closed; without objection it was so ordered.  Senator Bettencourt moved that SB 884 be reported back to the full Senate with the recommendation that it do not pass and be printed but that the committee substitute adopted in lieu thereof be passed and printed.  The motion carried with a record vote of 5 ayes, 0 nays, 0 present not voting, and 2 absent.  Senator Van Taylor submitted a motion in writing form requesting unanimous consent to be shown voting aye.  Senator Bettencourt moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The Chair laid out SB 744 and recognized the author, Senator Kolkhorst, to explain the bill.

 

Consideration of SB 744 was suspended temporarily.

 

The Chair laid out as a matter of pending business SB 601.  The Chair moved that SB 601 be left pending; without objection, it was so ordered.

 

The Chair laid out as a matter of pending business SB 881.  Senator Garcia moved that SB 881 be reported to the full Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nays, 0 present not voting, and 2 absent.  Senator Van Taylor submitted a motion in writing form requesting unanimous consent to be shown voting aye.  Senator Garcia moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The Chair laid out as a matter of pending business SJR 27.  Senator Bettencourt moved that SJR 27 be reported favorably to the full Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nays, 0 present not voting, and 2 absent.  Senator Van Taylor submitted a motion in writing form requesting unanimous consent to be shown voting aye.

 

The Chair laid out SB 744 and consideration of the bill resumed.  The Chair moved that public testimony be opened.  Witnesses testifying and registering on the bill are shown on the attached list.  The Chair moved that public testimony be closed; without objection; it was so ordered.  The Chair moved that SB 744 be left pending; without objection, it was so ordered.

 

The Chair moved the Committee stand at ease.

 

At 11:59 AM the Chair reconvened the Committee.

 

At 11:59 AM Senator Garcia assumed the chair.

 

The Chair laid out SB 937 and recognized Senator Lucio, Jr., in absence of the author, to explain the bill.  The Chair moved that public testimony be opened.  Witnesses testifying and registering on the bill are shown on the attached list.  The Chair moved that public testimony be closed; without objection, it was so ordered.  The Chair moved that SB 937 be left pending; without objection, it was so ordered.

 

At 12:14 PM Senator Lucio, Jr. resumed the chair.

 

There being no further business, at 12:14 PM the Chair moved that the Committee stand adjourned subject to the call of the chair.  Without objection, it was so ordered.
